1. Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel the service contract and obtain a refund for the unused portion, or to compensation for its reduced value. You are also entitled to choose a refund or replacement for major failures with goods. If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service.

The benefits conferred by these terms are in addition to all other rights and remedies available to consumers under the Competition and Consumer Act 2010 (Cth) and any other applicable laws.

2. Scope of Services

Mr. Phone Taigum ("we", "us", "our") provides mobile phone, tablet, and device repair services, data transfer services, and sale of accessories from our store at 217 Beams Road, Taigum Square Shopping Centre, Queensland. By engaging our services, you ("the customer") agree to these Terms & Conditions.

3. Repair Warranty

180-Day Warranty: Screen replacements, back glass repairs, housing repairs, charging port repairs, camera module repairs, and tablet/iPad repairs are covered by a 180-day warranty on parts and labour from the date of repair. If a warranted repair fails under normal use within this period, we will re-repair or replace the faulty part at no additional cost.

90-Day Warranty (Batteries): Battery replacements are covered by a 90-day warranty on the replacement battery. Batteries are consumable items and natural degradation over time is not covered.

Warranty Exclusions: Our repair warranty does not cover: (a) damage caused by accident, misuse, abuse, liquid contact, or unauthorised modification after our repair; (b) cosmetic damage including scratches, dents, and broken plastics that do not affect functionality; (c) damage caused by operating the device outside the manufacturer's intended conditions; (d) devices with broken or removed serial numbers; (e) issues unrelated to the original repair performed by us; (f) software-related issues, including operating system updates; (g) normal wear and tear.

To make a warranty claim, present your device along with your original repair receipt at our store. We will inspect the device and determine if the issue falls within warranty coverage. Warranty repairs are typically completed with the same turnaround time as the original repair.

4. Repair Process & Authorisation

Upon receiving your device, we will conduct a diagnostic assessment and provide a quote for the recommended repair. Repair work will only commence once you have authorised the quoted repair and price. If during the repair process we discover additional issues not covered in the original quote, we will contact you for authorisation before proceeding with any additional work.

We reserve the right to decline any repair that we determine cannot be completed safely or effectively.

5. Parts & Components

We use high-quality replacement parts that are equivalent to or exceed the specifications of the original manufacturer's components. Unless specifically stated otherwise, parts used are not sourced directly from the original manufacturer (OEM) but are premium aftermarket equivalents. Goods presented for repair may be replaced by refurbished goods of the same type rather than being repaired. Refurbished parts may be used to repair the goods.

6. Data Loss & Backup

Important: The repair of electronic devices may result in the loss of data stored on your device. It is the customer's sole responsibility to ensure that a complete backup of all data (including but not limited to contacts, photos, messages, applications, and settings) is performed prior to submitting the device for repair. Mr. Phone Taigum is not responsible for any data loss that occurs as a direct or indirect result of the repair process.

We recommend backing up your device via iCloud, Google Drive, Samsung Cloud, or a local computer backup before your appointment.

7. Pricing & Payment

All prices are quoted in Australian Dollars (AUD) and are inclusive of GST. The price quoted at the time of repair authorisation is the price you will pay, unless additional work is authorised by you. Payment is required upon completion of the repair, prior to the return of your device. We accept cash, EFTPOS, Visa, MasterCard, and American Express.

8. Turnaround & Collection

Most common repairs (screen replacement, battery replacement) are completed within 30–60 minutes. More complex repairs or repairs requiring ordered parts may take longer — we will advise you of the expected turnaround at the time of booking or drop-off.

Uncollected Devices: Devices left at our store for more than 30 days after notification that the repair is complete, without contact from the customer, will be deemed abandoned. We will make reasonable attempts to contact you. After 90 days, abandoned devices may be disposed of or recycled in accordance with applicable laws, and no liability will be accepted for the device or its contents.

9. Limitation of Liability

To the maximum extent permitted by law, our total liability for any claim arising from or related to our repair services is limited to the amount you paid for the specific repair giving rise to the claim. We are not liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of data, loss of use, loss of revenue, or loss of business opportunity.

This clause does not exclude or limit any rights you have under the Australian Consumer Law or other applicable consumer protection legislation.

10. Device Condition & Pre-existing Damage

Prior to repair, we will note the general condition of your device. We are not responsible for any pre-existing faults, damage, or conditions that are unrelated to the repair we are performing. If pre-existing damage is discovered during the repair that may affect the outcome, we will advise you before proceeding.

Repair of your device may impact the water resistance rating of your device. Post-repair, the device may not retain the same level of water resistance as when originally manufactured.

11. Manufacturer's Warranty

Following the landmark ACCC v Apple court case (2018), screen repairs by a third-party provider such as Mr. Phone Taigum should not void your manufacturer's warranty. However, other repairs (including battery replacements and housing repairs) may impact your warranty depending on the manufacturer's specific terms. We recommend reviewing your manufacturer's warranty terms before proceeding with non-screen repairs.

12. Special Orders

Special orders for parts or non-standard repairs are subject to availability and may require a deposit. Deposits for special orders are non-refundable if the customer changes their mind after the part has been ordered. If we are unable to source the requested part, any deposit paid will be refunded in full.

13. Accessories & Product Sales

Accessories and products sold by Mr. Phone Taigum carry the manufacturer's warranty as specified on the product packaging. Where no manufacturer's warranty is stated, a reasonable warranty period applies in accordance with the Australian Consumer Law. Unfortunately, we are unable to accept change-of-mind returns or exchanges on accessories and products. However, we are happy to accept returns on faulty accessories — simply bring the item back to our store with your receipt and we will arrange a replacement or resolution for you. Your rights under the Australian Consumer Law are not affected.

14. Governing Law

These Terms & Conditions are governed by the laws of Queensland, Australia. Any dispute arising from these terms shall be subject to the jurisdiction of the courts of Queensland.

15. Changes to Terms

We reserve the right to update these Terms & Conditions at any time. The most current version will always be available on our website. Continued use of our services after any changes constitutes acceptance of the updated terms.

We use your personal information to: process and manage your repair booking, contact you regarding your repair status, provide warranty service, send appointment confirmations and reminders via SMS or email, respond to your enquiries, improve our services, and comply with legal obligations.

4. Disclosure of Information

We do not sell, trade, or rent your personal information to third parties. We may share your information with: parts suppliers (only where necessary to process a warranty claim), payment processors to complete transactions, and government bodies or law enforcement where required by law.

5. Data Security

We take reasonable steps to protect your personal information from misuse, interference, loss, unauthorised access, modification, and disclosure. Physical records are stored securely at our premises. Digital records are stored in password-protected systems with restricted access.

6. Data Retention

We retain your personal information for as long as reasonably necessary to fulfil the purposes for which it was collected, including for warranty administration (up to 180 days after repair, or longer if required by law). Repair records may be retained for up to 7 years for accounting and legal purposes. You may request deletion of your personal information at any time, subject to our legal retention obligations.

Under the Australian Privacy Act, you have the right to: access the personal information we hold about you, request correction of any inaccurate information, request deletion of your information (subject to legal requirements), and lodge a complaint if you believe your privacy has been breached.
